Under the updated law, a fine is introduced for serious offenders. The fine for offenders for inducing drug use or facilitating has significantly increased from AED 200,000 to AED 500,000. Additionally, a minimum of 5 years of imprisonment is also in place. There has been a radical shift in the approach under which the drug use act is considered as an illness rather than a criminal action. The new legislation will allow the courts to decide whether the offender needs to be sent to rehabilitation centers or prison.
Moreover, the new reforms call for the establishment of a rehabilitation center for drug users. There they will be supported to get back to normal life and will be educated to become calmer and sober. Moreover, they will be prepared for reintroduction to society. The rehabilitation approach is available only for first-time drug offenders. It is proved through the medical assessment that this is the first time to get into drugs. Under the law, expatriates are usually deported to their home country after being jailed. Now under the new reforms, it allows the expats to return, deport or sentence to jail. All this is up to the judges and jury to make the decision.
For the repeated offender there is a prison sentence of 3 years with a fine of AED 30,000 and AED 100,000. Although, the court does have the right to decide whether the first or the second will result in a fine or imprisonment. The third offense will result in a minimum of 2 years of jail along with a minimum fine of AED 200,000. Although the jail sentences have been reduced for the first time, still the offenders will be offered rehabilitation. A stricter stance taken to curb drug promotion and trafficking appears to be highly effective once they are applied in full swing.
